Prosecutor Randy Gaylord removed as Defendant in the Public Records Suit

Defendant San Juan County and Plaintiff Sheryl Albritton reached an agreement last month which terminates the lawsuit filed in October in Skagit County Superior Court entitled Albritton v. San Juan County and Randall Gaylord. Separate Stipulations agreed that Gaylord, County Prosecutor, is dismissed as defendant from the suit, without prejudice and without attorneys’ fees and costs to either party.
The agreement provides judgment to be entered against San Juan County in favor of Sheryl Albritton for $22,501 dollars.
Sanctions against the plaintiff’s attorney, Nick Power were also removed in the agreement.
The case alleged that the County elected officials and employees conspired to withhold from Albritton documents that she is entitled to review under Washington’s Open Public Records Act, RCW 42.56.
As part of the settlement, Albritton was given the requested documents, according to her attorney.
